1. About these Terms
1.1 These Terms and Conditions (Terms) govern your access to and use of www.thankgod.au (Website) and your purchase of any products from us. "Thank God" is a business name of JMJ Care Pty Ltd (ABN 82 644 225 534) of Sydney, New South Wales (we, us, our).
1.2 By using the Website or placing an order, you agree to be bound by these Terms, together with our Subscription Terms, Refunds and Returns Policy, Privacy Policy and Cookie Policy, each of which forms part of these Terms (together, the Policies). If you do not agree, you must not use the Website or place an order.
1.3 If there is any inconsistency between these Terms and a Policy, the Policy prevails to the extent of the inconsistency in relation to its subject matter.
1.4 We may amend these Terms from time to time by publishing an updated version on the Website. The version in force at the time you place an order applies to that order. For subscriptions, changes apply in accordance with the Subscription Terms.
2. Your rights under the Australian Consumer Law
2.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
2.2 Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth) or any other legislation that cannot lawfully be excluded, restricted or modified (Non-Excludable Rights).
3. Eligibility
3.1 You must be at least 18 years of age to place an order on the Website. By placing an order, you represent and warrant that you are at least 18 years of age and that the information you provide is true, accurate and complete.
3.2 We supply products only to delivery addresses within Australia.
4. Our products
4.1 Our products, including Thank God Daily · Mango and Thank God Night · Chocolate (Products), are food products. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. They are not a substitute for a varied and balanced diet.
4.2 The Products are not suitable for children, or for persons who are pregnant or breastfeeding. If you have a medical condition, take any medication, or have any allergy or sensitivity, you should consult a qualified health professional before consuming the Products.
4.3 You must read and follow the directions, warnings and ingredient information on the Product label before use. Where information on the Website differs from the information on the Product label, the Product label prevails.
4.4 Ingredient quantities shown on the Website for the founding production run are subject to confirmation by independent laboratory testing before dispatch. If any final ingredient quantity differs materially from that shown at the time of your order, we will notify you before dispatch and you may cancel your order for a full refund.
4.5 Product images are for illustration only. Packaging, colours and presentation may vary.
5. Orders
5.1 Your order is an offer to purchase the Products in your order on these Terms. A contract is formed only when we accept your order by sending an order confirmation email to the address you provided.
5.2 We may decline or cancel any order (in whole or in part) before dispatch, including where a Product is unavailable, where a price or description has been displayed in error, where we reasonably suspect fraud, or where the order does not comply with these Terms. If we cancel an order, we will refund any amount you have paid for the cancelled part of the order.
5.3 We may limit the quantity of any Product that may be purchased per person, household or order.
6. Pre-orders
6.1 Products identified on the Website as available for pre-order (Pre-order Products) have not yet been dispatched from production. Payment for Pre-order Products is taken at the time of order.
6.2 The estimated dispatch date shown on the Website or at checkout (Estimated Dispatch Date) is an estimate only. We will notify you by email if we expect dispatch to be delayed.
6.3 If your Pre-order Products have not been dispatched within 7 days after the Estimated Dispatch Date, you may cancel your order by email to admin@jmjhomes.com.au at any time before dispatch, and we will refund the full amount paid for that order.
6.4 Founding prices and allocations for the founding production run are available only while stock from that run lasts and may end without notice once that run is fully allocated.
7. Prices and payment
7.1 All prices are in Australian dollars and include GST where applicable.
7.2 We may change prices at any time, but price changes will not affect orders already accepted. Price changes for subscriptions are governed by the Subscription Terms.
7.3 Payment must be made at checkout using a payment method we accept. Payments are processed by Shopify and its payment partners. We do not receive or store your full card details.
7.4 You authorise us and our payment processors to charge your nominated payment method for all amounts payable under these Terms and the Subscription Terms.
8. Delivery
8.1 Standard shipping is free on every Subscription Delivery and on one-time orders of $120 or more to Australian addresses. Other orders are charged a flat $10 standard shipping fee, which is shown at checkout before you pay. Express shipping may be offered free of charge on orders of $250 or more, or at the price shown at checkout.
8.2 Delivery timeframes are estimates only. Subject to your Non-Excludable Rights, we are not liable for delays caused by carriers or by events beyond our reasonable control.
8.3 You must provide a complete and accurate delivery address. We are not responsible for failed or misdirected deliveries caused by an incorrect or incomplete address. Any cost of re-delivery arising from an incorrect address may be charged to you.
8.4 Title to and risk in the Products pass to you on delivery to the address in your order.
9. Returns and refunds
9.1 Returns, replacements and refunds are governed by our Refunds and Returns Policy, which forms part of these Terms.
10. Promotions, Founders Club and free items
10.1 Promotions, discount codes, founding prices and free items are subject to any conditions stated in the relevant offer, may be withdrawn at any time, cannot be exchanged for cash, and cannot be combined with other offers unless we state otherwise.
10.2 Membership of the Founders Club is free. It entitles members to receive communications and early access as described on the Website, but does not guarantee the availability of any Product or price.
11. Use of the Website
11.1 You must not use the Website for any unlawful purpose; interfere with or disrupt the Website or its security; attempt to gain unauthorised access to any part of the Website or our systems; or use any automated means to access or collect content from the Website.
11.2 We do not guarantee that the Website will be available at all times or free of errors, viruses or interruptions.
11.3 The Website may contain links to third-party websites. We are not responsible for the content or practices of those websites.
12. Intellectual property
12.1 All intellectual property rights in the Website and its content, including the Thank God name, logos, trade marks, packaging designs, text, graphics, photographs and software, are owned by or licensed to us.
12.2 You may view the Website for personal, non-commercial purposes. You must not copy, reproduce, modify, distribute or otherwise use any content from the Website without our prior written consent.
13. Limitation of liability
13.1 Subject to your Non-Excludable Rights, and to the maximum extent permitted by law, we exclude all express and implied warranties, conditions and representations not set out in these Terms.
13.2 Where our liability for failure to comply with a consumer guarantee may lawfully be limited, our liability is limited, at our option, to replacing the Products or supplying equivalent Products, or paying the cost of replacing the Products or acquiring equivalent Products.
13.3 Subject to your Non-Excludable Rights, and to the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or any loss of profit, revenue or opportunity, arising out of or in connection with these Terms or the Products, except to the extent the loss was a reasonably foreseeable consequence of our failure to comply with a consumer guarantee.
13.4 Nothing in this clause limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be limited by law.
14. Events beyond our control
14.1 We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, pandemics, industrial action, supplier or manufacturer failure, carrier delays, or government action. If such an event affects your order, we will notify you, and if we cannot fulfil your order within a reasonable time, you may cancel it and we will refund the amount paid for the unfulfilled part.
15. Privacy
15.1 We collect, use and disclose your personal information in accordance with our Privacy Policy.
16. General
16.1 These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
16.2 If any provision of these Terms is invalid or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue in full force.
16.3 Our failure to enforce any provision of these Terms is not a waiver of our right to do so.
16.4 You may not assign or transfer your rights under these Terms without our written consent.
