1.1 This Privacy Policy explains how JMJ Care Pty Ltd (ABN 82 644 225 534), trading as Thank God, of Sydney, New South Wales (we, us, our), collects, holds, uses and discloses your personal information.

1.2 We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1.3 By using www.thankgod.au (Website), placing an order or joining the Founders Club, you consent to the collection, use and disclosure of your personal information as described in this Privacy Policy.

2. What personal information we collect

2.1 We may collect the following personal information:

  • (a) identity and contact details, such as your name, email address, phone number and delivery and billing addresses;
  • (b) order and subscription details, such as the Products you purchase, your order history, subscription status and communications with us;
  • (c) payment information, limited to transaction records and the last four digits of your card. Full card details are collected and processed by Shopify and its payment partners and are not received or stored by us;
  • (d) account information, such as your login email and account preferences;
  • (e) marketing preferences, including whether you have consented to receive marketing communications; and
  • (f) technical and usage information, such as your IP address, device and browser type, pages viewed, Products viewed or added to your bag, and how you arrived at the Website, collected through cookies and similar technologies as described in our Cookie Policy.

2.2 We do not seek to collect sensitive information, including health information. If you choose to provide health information to us (for example, when contacting us about a Product), we will collect it only with your consent and use it only to respond to your enquiry.

2.3 You may interact with us anonymously or using a pseudonym when making general enquiries. However, we cannot process orders without your name, contact details and delivery address.

3. How we collect personal information

3.1 We collect personal information directly from you when you place an order, create an account, subscribe, join the Founders Club, enter a promotion, or contact us.

3.2 We collect technical and usage information automatically through cookies, pixels and similar technologies when you use the Website or interact with our emails.

3.3 We may collect personal information from third parties, such as Shopify, delivery carriers and advertising platforms, where you have interacted with them in connection with our Products.

4.1 We collect, hold and use personal information to:

  • (a) process, fulfil and deliver your orders and Subscriptions, including taking payments;
  • (b) manage your account and communicate with you about your orders, Subscriptions and enquiries;
  • (c) send you Founders Club updates, offers and other marketing, where you have consented;
  • (d) operate, maintain, secure and improve the Website and our Products;
  • (e) measure and improve the effectiveness of our advertising;
  • (f) detect and prevent fraud and misuse; and
  • (g) comply with our legal obligations, including tax, accounting and consumer law obligations.

5. Disclosure of personal information

5.1 We may disclose personal information to:

  • (a) Shopify, which hosts our online store and processes checkout and payments;
  • (b) delivery and logistics providers, to deliver your orders;
  • (c) email and customer communications providers, such as Klaviyo, to send transactional and marketing emails;
  • (d) Meta Platforms, Inc., through the Meta Pixel, to measure and improve our advertising, as described in our Cookie Policy;
  • (e) our professional advisers, such as accountants and lawyers; and
  • (f) government authorities or other parties, where required or authorised by law.

5.2 We require our service providers to handle personal information securely and only for the purposes for which it was disclosed.

5.3 We do not sell your personal information.

6. Overseas disclosure

6.1 Some of our service providers store or process personal information outside Australia, including in the United States, Canada and the European Union. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the APPs.

7. Marketing

7.1 We will send you marketing communications only where you have consented to receive them, in accordance with the Spam Act 2003 (Cth).

7.2 You may unsubscribe at any time by using the unsubscribe link in any marketing email or by contacting us. We will action your request within 5 business days. We will continue to send you transactional messages relating to your orders and Subscriptions.

7.3 You can manage how Meta uses information for advertising through your Meta ad preferences at facebook.com/adpreferences.

8. Security

8.1 We take reasonable steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification and disclosure. These steps include using reputable service providers with secure, encrypted systems and restricting access to personal information to those who need it.

Order and transaction records are kept for at least 5 years to meet tax and accounting obligations. 11.1 Our Website and Products are not directed at persons under 18 years of age, and we do not knowingly collect personal information from children.

12.1 If you have a complaint about how we have handled your personal information, please contact us in writing using the details in clause 13. We will acknowledge your complaint within 7 days and aim to respond within 30 days.
